Terms and Conditions for Electronic Services
These Terms and Conditions set out the rules for using Menulab — a SaaS platform for hospitality businesses that enables creation and publication of digital menus, user account management, subscription plans, custom domain connection, and customer communication. The Terms are drafted for an EU/EEA-facing service; the governing law is stated in the final section.
§ 1. Service provider
The provider of Menulab is Andrii Skovron, correspondence address: ul. Zarzecze 30a/1 Giebultow 32-085, contact email: hello@menulab.eu.
Menulab is available in particular at menulab.eu and qrinfo.cc, as well as via related subdomains, the customer dashboard, and custom domains configured by customers.
§ 2. Definitions
- Service — the digital and electronic services provided by Menulab, including the management dashboard, menu publication, user accounts, plan handling, and email communication.
- Customer — a natural person, legal person, or organisational unit using Menulab in their own name, in particular a restaurant or other hospitality business.
- Consumer — a natural person acting for purposes that are outside their trade, business, craft, or profession.
- Account — individual access to the Menulab dashboard, secured by a login and authentication method.
- Subscription — paid access to a selected Menulab plan billed on a recurring basis.
- Customer Content — all data, materials, and information entered into Menulab by the customer, including menus, prices, photos, allergens, descriptions, and domains.
§ 3. Nature and scope of the Service
Menulab enables, in particular:
- creating and maintaining a user account;
- managing restaurant, category, and product information;
- publishing a digital menu at a public address or the customer's own domain;
- handling subscription plans and trial periods;
- sending messages related to the account, billing, and support, and — with consent — a newsletter;
- customer contact and technical support.
Unless expressly stated otherwise, Menulab is not a party to transactions between a restaurant and its end guests and is not responsible for the sale of food or drink products, their availability, composition, prices, or the accuracy of allergen labelling entered by the restaurant.
§ 4. Technical requirements
To use Menulab, you need:
- a device with Internet access;
- a current web browser that supports JavaScript and HTTPS;
- an active email account able to receive service-related messages;
- for selected features — the ability to configure DNS and a custom domain.
§ 5. Contract formation and user account
A contract for electronic services is formed when an account is successfully created or when the customer starts using the relevant Menulab feature.
The customer agrees to:
- provide true and up-to-date information;
- secure account access against unauthorised persons;
- promptly update billing and contact details;
- use Menulab in accordance with law, fair practice, and these Terms.
§ 6. Customer obligations and prohibited content
The customer must not:
- supply unlawful content, content that infringes third-party rights, or content that is misleading;
- publish false information about products, prices, allergens, or ingredients;
- take actions that may disrupt Menulab or the security of its infrastructure;
- share the account with unauthorised persons in breach of the selected plan terms.
The customer is responsible for the lawfulness, completeness, and accuracy of Customer Content. This applies in particular to allergen information, prices, product descriptions and photos, and rights to domains, trademarks, and graphic materials.
§ 7. Custom domain and menu publication
If the customer uses the custom-domain feature, they represent that they are entitled to use that domain and to make the required DNS configuration changes.
The provider is not responsible for menu unavailability caused by incorrect DNS configuration, or by failures of a domain registrar or hosting outside Menulab's control.
§ 8. Trial period, subscription, and payments
Menulab may offer a free trial, currently up to 7 days for selected plans. During the trial, the customer may cancel without charge unless the offer states otherwise.
After the trial ends or after a paid plan is chosen, fees are charged on a recurring basis according to the selected billing interval (for example monthly or yearly) via an external payment provider.
- prices are shown in the Menulab price list; for consumers, unless stated otherwise, prices should be understood as including applicable taxes;
- payments are handled by Stripe or another designated payment provider;
- full payment card details are not stored by Menulab;
- the customer accepts recurring charges to the selected payment method until the subscription is cancelled;
- if payment fails, the provider may restrict access to paid features after prior notice to settle outstanding amounts.
§ 9. Duration, cancellation, and termination
The customer may cancel a paid subscription before the next billing period starts. Cancellation stops charges for the next period, while access remains active until the end of the already-paid period, unless the offer states otherwise.
The provider may terminate or suspend the Service for material breach of these Terms, unlawful use of Menulab, or non-payment — after an unsuccessful request to stop the breach or settle amounts due, where the situation requires it.
§ 10. Consumer right of withdrawal
A consumer has the right to withdraw from a distance contract within 14 days of conclusion, without giving a reason, subject to exceptions provided by applicable law.
If the consumer expressly requests that performance begin before the withdrawal period expires and then withdraws, they may be required to pay for services provided up to withdrawal, in proportion to what was performed.
A withdrawal notice may be sent to hello@menulab.eu or ul. Zarzecze 30a/1 Giebultow 32-085.
§ 11. Complaints and support
Complaints about Menulab may be submitted by email to hello@menulab.eu. Please include identifying details, a description of the issue, and the expected resolution.
Complaints are handled without undue delay and no later than 14 days, unless the nature of the matter requires longer — in which case the customer will be informed.
§ 12. Liability
The provider takes due care to keep Menulab available and secure, but reserves the possibility of temporary technical, maintenance, or outage-related interruptions beyond its control.
- the provider is not liable for consequences of false or incomplete data provided by the customer;
- the provider is not liable for content published by the customer, including incorrect product, price, or allergen information;
- in relationships with businesses, the provider's liability for lost profits is excluded to the fullest extent permitted by law;
- nothing in these Terms excludes or limits consumer rights that cannot be waived under mandatory law.
§ 13. Intellectual property
Rights in Menulab, its software, interface layout, marks, and materials provided by the provider belong to the provider or other rights holders.
The customer retains rights in Customer Content, but grants the provider a non-exclusive licence needed to host, process, and publish that content in order to provide the Service.
§ 14. Personal data
Personal data processing is described in the Privacy Policy, which forms an integral supplement to these Terms.
§ 15. Dispute resolution and final provisions
These Terms are governed by the law of Poland, where the provider is established, without prejudice to mandatory consumer protections that may apply in the consumer's country of residence within the EU/EEA. Consumers may also use out-of-court complaint and redress mechanisms, including the European Commission ODR platform where available.
For customers who are not consumers, disputes shall be resolved by the court competent for the provider's place of establishment, unless mandatory law provides otherwise.
These Terms take effect on publication. The provider may amend them for important reasons, such as changes in law, the scope of services, or billing. Customers will be informed of material changes with reasonable advance notice.
